PROPERTY This Agreement applies to the private lake house located at Smith Mountain Lake, Virginia. The property's physical address will be provided after booking confirmation. 2. RENTAL TERM Check-In: ______________________________ Check-Out: _____________________________ Guests agree to vacate the property by the designated checkout time. Late departures may result in additional charges. 3. PAYMENT & SECURITY DEPOSIT Rental fees shall be paid according to the booking platform or payment arrangement. A refundable security deposit of $350 is required. The security deposit may be used to cover: -Property damage -Missing items -Excessive cleaning -Smoking violations -Unauthorized guests or parties -Pet-related damage or cleaning -Dock or watercraft damage -Any violation of this Agreement Guests remain responsible for damages and costs that exceed the amount of the security deposit. The security deposit will be refunded within seven (7) days after checkout, less any applicable deductions. 4. MAXIMUM OCCUPANCY Maximum Occupancy: 7 Guests Only individuals listed on the reservation are permitted on the property. No additional guests, visitors, parties, events, or gatherings are permitted without prior written approval from the Owner/Manager. Unauthorized guests or visitors may result in: -Immediate termination of the rental -Removal from the property -Forfeiture of the security deposit -Additional fees for unauthorized occupancy 5. HOUSE RULES Smoking: Smoking is strictly prohibited. This includes: -Cigarettes -Cigars -Marijuana -E-cigarettes -Vaping devices -Any other smoking products Smoking is not permitted anywhere on the property, including: -Inside the home -Decks -Dock -Driveway -Yard Violation of this policy may result in immediate eviction without refund and forfeiture of the security deposit. Pets: Only house-trained dogs are permitted with prior written approval. Guests agree to: -Keep pets off all furniture, including beds, couches, and chairs -Clean up pet waste promptly -Prevent excessive barking or nuisance behavior Guests are responsible for any pet-related damage, odors, stains, scratching, chewing, excessive hair, or additional cleaning required due to pets. No other pets are permitted. Noise & Conduct: Quiet hours are from 10:00 PM to 8:00 AM. Guests must respect neighboring properties and avoid: -Loud music -Excessive noise -Disturbing behavior -Disorderly conduct Fireworks & Hazardous Activities: No fireworks, explosives, pyrotechnics, open burning, or unlawful activities are permitted on the property. Property Care: Guests agree to treat the property and amenities with care. Food and beverages are prohibited on or around the pool table. Guests are responsible for any damage caused to: -The home -Furnishings -Appliances -Dock -Recreational equipment -Other amenities 6. LAKE, DOCK & WATER ACTIVITY RULES Use of the lake, shoreline, dock, kayaks, paddleboards, floats, life jackets, and recreational equipment is entirely at the guest's own risk. Children must be supervised at all times around the water. Guests agree to: -Wear life jackets while using kayaks, paddleboards, or other watercraft -Follow all applicable Virginia boating and water safety laws -Use equipment safely and responsibly -Return all equipment to its designated storage location after use Guests are responsible for any loss, theft, misuse, or damage to recreational equipment. Guests are fully responsible for any damage caused to boats, jet skis, docks, lifts, watercraft, or related equipment. 7. LAKE CONDITIONS DISCLAIMER Lake conditions are controlled by factors outside the Owner's control, including: -Weather -Drought -Rainfall -Dam operations -Water levels -Water quality -Algae blooms -Aquatic vegetation -Floating debris -Other environmental conditions The Owner/Manager makes no representation regarding: -Lake depth -Swimming conditions -Fishing conditions -Boating conditions -Water quality -Dock accessibility If lake levels or environmental conditions render the dock partially or fully unusable, no refund, credit, cancellation, compensation, or reduction in rental charges shall be provided. Changes in lake conditions, weather conditions, or other natural events shall not constitute grounds for cancellation or refund. 8. LIABILITY WAIVER & ASSUMPTION OF RISK Guest acknowledges that staying at a lakefront property involves inherent risks, including but not limited to: -Swimming and water-related activities -Drowning risks -Dock and shoreline use -Boating and watercraft use -Slippery surfaces -Uneven terrain -Wildlife encounters -Recreational equipment use -Weather-related hazards Guest voluntarily assumes all risks associated with occupancy and use of the property. Guest agrees to release, indemnify, defend, and hold harmless the Owner/Manager from claims, demands, liabilities, damages, losses, costs, and expenses arising from Guest's use of the property, except where prohibited by applicable law. Guest accepts full responsibility for supervising all members of their party, including children. 9. CANCELLATION POLICY Cancellations made more than thirty (30) days prior to check-in will receive a full refund. Cancellations made within thirty (30) days of check-in are non-refundable unless otherwise required by law. Reservations made through third-party booking platforms may also be subject to that platform's cancellation policies. 10. DEFAULT & REMOVAL Violation of any provision of this Agreement may result in immediate termination of the rental without refund. The Owner/Manager reserves the right to remove any guest who: -Violates this Agreement -Engages in unlawful conduct -Creates a nuisance -Damages property -Creates unsafe conditions 11. COLLECTION OF DAMAGES Guests are responsible for all damages, losses, excessive cleaning costs, attorney's fees, court costs, collection costs, and other expenses incurred by the Owner/Manager as a result of damage to the property or violation of this Agreement. 12. GOVERNING LAW This Agreement shall be governed by and interpreted under the laws of the Commonwealth of Virginia. 13. ENTIRE AGREEMENT This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions, representations, and understandings. Any modification must be made in writing and signed by both parties. 14.
